1. DEFINITIONS
1. For the purposes of these Terms and Conditions, the Parties agree to the following definitions:
- a) GO PARK / Company: GO PARK, LDA., the entity responsible for providing parking services and complementary services.
- b) Car Park: a group of covered and uncovered car parks operated by GO PARK, with permanent surveillance 24 hours a day, 365 days a year.
- c) Official Vehicle Drop-off Location: Rua do Barreiro, no. 492, Warehouse D, Moreira, 4470-573 Maia.
- d) Customer: Any individual or legal entity contracting the services.
- e) Vehicle: A motor vehicle for which the Customer holds lawful entitlement to use.
- f) Airport: Francisco Sá Carneiro Airport.
2. OBJECT
GO PARK provides motor vehicle parking services and associated complementary services.
3. DURATION
The contract remains in force for the period contracted by the Customer, and may be altered by mutual agreement between the parties.
4. SERVICES PROVIDED
1. The following services will be provided to the Customer:
- a) Parking of the Vehicle at the Car Park's facilities for the duration of this Contract.
- b) Valet Service: collection and delivery of the Customer's Vehicle at the Airport, when specifically agreed between the Customer and the Company, with a minimum advance notice of 12 hours, to be carried out by duly qualified Company employees.
- c) Transfer Transport: transportation of the Customer, their companions and luggage, from the Car Park to the Airport and vice versa, in Company transport, when requested.
- d) Washing/vacuuming, electric charging and other additional services, when specifically requested by the Customer or offered by the Company.
2. Authorised GO PARK employees may move vehicles between car parks operated by the Company located within a maximum radius of 5 km from each other, whenever necessary for operational management, internal reorganisation or optimisation of available spaces.
5. PRICES AND PAYMENT
1. The applicable prices correspond to the values presented on the website, authorised platforms or GO PARK facilities.
2. Each billing period corresponds to minimum fractions of 24 hours.
6. CUSTOMER OBLIGATIONS
The Customer undertakes to:
- 1. Deliver the Vehicle in normal working condition;
- 2. Provide the necessary means for moving the Vehicle;
- 3. Remove personal belongings and valuables;
- 4. Comply with the indicated dates and times;
- 5. Make full payment;
- 6. Comply with safety rules.
7. CHECK-IN AND CHECK-OUT
1. At the time of delivery, an inspection will be carried out including:
- a) mileage;
- b) fuel level;
- c) interior and exterior condition;
- d) existing damage;
- e) photographic records.
2. A final inspection will be carried out at the time of collection.
3. Any complaints regarding the condition of the Vehicle must be submitted immediately after the delivery procedure is completed.
8. COMPANY LIABILITY
1. GO PARK is solely liable for damage directly attributable to acts or omissions by its employees in the performance of their duties.
2. The following are excluded:
- a) damage, wear, defects or breakdowns existing at the date of check-in;
- b) items left inside the Vehicle;
- c) mechanical failures not attributable to GO PARK;
- d) damage caused by third parties, extraordinary natural phenomena or force majeure;
- e) damage not visible due to the condition or dirtiness of the Vehicle.
3. No exclusion shall take effect where legally prohibited.
9. CUSTOMER LIABILITY
1. The Customer is liable for fines, penalties, damage, fires or any other incidents caused by their Vehicle.
2. Without prejudice to the Company's rights of defence as permitted by law, the Customer shall reimburse the Company for all costs incurred, including legal costs for lawyers and solicitors.
10. RIGHT OF RETENTION
In the event of non-payment, GO PARK may exercise a right of retention in accordance with applicable law.
11. DATA PROTECTION
Personal data and images collected will be processed in accordance with applicable legislation and GO PARK's Privacy Policy.
12. SPECIFIC SERVICES
Specific rules apply to Transfer, Valet, Electric Charging, Washing/Vacuuming and Key Handover services.
13. UNAUTHORISED PARKING
Unauthorised parking includes any unauthorised stay, abandonment or failure to make payment.
14. OPENING HOURS
Open 24 hours a day.
15. APPLICABLE LAW AND JURISDICTION
1. Portuguese law applies.
2. Without prejudice to mandatory provisions relating to consumer protection, the Court of the District of Porto shall have jurisdiction.
